This diversity is embodied in the uniqueness and plurality of the identities of the groups and societies making up humankind. In this sense, it is the common heritage of humanity and should be recognized and affirmed for the benefit of present and future generations.</span><br style="background-color: white;" /><br style="background-color: white;" /><b style="background-color: white;">Article 2 From cultural diversity to cultural pluralism</b><span style="background-color: white;"></span><br style="background-color: white;" /><br style="background-color: white;" /><span style="background-color: white;">In our increasingly diverse societies, it is essential to ensure harmonious interaction among people and groups with plural, varied and dynamic cultural identities as well as their willingness to live together. Policies for the inclusion and participation of all citizens are guarantees of social cohesion, the vitality of civil society and peace. Thus defined, cultural pluralism gives policy expression to the reality of cultural diversity. Indissociable from a democratic framework, cultural pluralism is conducive to cultural exchange and to the flourishing of creative capacities that sustain public life.</span><br style="background-color: white;" /><br style="background-color: white;" /><b style="background-color: white;">Article 3 – Cultural diversity as a factor in development</b><span style="background-color: white;"></span><br style="background-color: white;" /><br style="background-color: white;" /><span style="background-color: white;">Cultural diversity widens the range of options open to everyone; it is one of the roots of development, understood not simply in terms of economic growth, but also as a means to achieve a more satisfactory intellectual, emotional, moral and spiritual existence.</span><br style="background-color: white;" /><br style="background-color: white;" /><b style="background-color: white;">CULTURAL DIVERSITY AND HUMAN RIGHTS<br /><br />Article 4 – Human rights as guarantees of cultural diversity</b><span style="background-color: white;"></span><br style="background-color: white;" /><br style="background-color: white;" /><span style="background-color: white;">The defence of cultural diversity is an ethical imperative, inseparable from respect for human dignity. It implies a commitment to human rights and fundamental freedoms, in particular the rights of persons belonging to minorities and those of indigenous peoples. No one may invoke cultural diversity to infringe upon human rights guaranteed by international law, nor to limit their scope.</span><br style="background-color: white;" /><br style="background-color: white;" /><b style="background-color: white;">Article 5 – Cultural rights as an enabling environment for cultural diversity</b><span style="background-color: white;"></span><br style="background-color: white;" /><br style="background-color: white;" /><span style="background-color: white;">Cultural rights are an integral part of human rights, which are universal, indivisible and interdependent. The flourishing of creative diversity requires the full implementation of cultural rights as defined in Article 27 of the Universal Declaration of Human Rights and in Articles 13 and 15 of the International Covenant on Economic, Social and Cultural Rights. All persons have therefore the right to express themselves and to create and disseminate their work in the language of their choice, and particularly in their mother tongue; all persons are entitled to quality education and training that fully respect their cultural identity; and all persons have the right to participate in the cultural life of their choice and conduct their own cultural practices, subject to respect for human rights and fundamental freedoms.</span><br style="background-color: white;" /><br style="background-color: white;" /><b style="background-color: white;">Article 6 – Towards access for all to cultural diversity</b><span style="background-color: white;"></span><br style="background-color: white;" /><br style="background-color: white;" /><span style="background-color: white;">While ensuring the free flow of ideas by word and image care should be exercised so that all cultures can express themselves and make themselves known. Freedom of expression, media pluralism, multilingualism, equal access to art and to scientific and technological knowledge, including in digital form, and the possibility for all cultures to have access to the means of expression and dissemination are the guarantees of cultural</span><br style="background-color: white;" /><span style="background-color: white;">diversity.</span></span></span></div><div><span style="font-family: helvetica;"><span style="font-size: medium;"><br style="background-color: white;" /><br style="background-color: white;" /><b style="background-color: white;">CULTURAL DIVERSITY AND CREATIVITY<br /><br />Article 7 – Cultural heritage as the wellspring of creativity</b><span style="background-color: white;"></span><br style="background-color: white;" /><br style="background-color: white;" /><span style="background-color: white;">Creation draws on the roots of cultural tradition, but flourishes in contact with other cultures. For this reason, heritage in all its forms must be preserved, enhanced and handed on to future generations as a record of human experience and aspirations, so as to foster creativity in all its diversity and to inspire genuine dialogue among cultures.</span><br style="background-color: white;" /><br style="background-color: white;" /><b style="background-color: white;">Article 8 – Cultural goods and services: commodities of a unique kind</b><span style="background-color: white;"></span><br style="background-color: white;" /><br style="background-color: white;" /><span style="background-color: white;">In the face of present-day economic and technological change, opening up vast prospects for creation and innovation, particular attention must be paid to the diversity of the supply of creative work, to due recognition of the rights of authors and artists and to the specificity of cultural goods and services which, as vectors of identity, values and meaning, must not be treated as mere commodities or consumer goods.</span><br style="background-color: white;" /><br style="background-color: white;" /><b style="background-color: white;">Article 9 – Cultural policies as catalysts of creativity</b><span style="background-color: white;"></span><br style="background-color: white;" /><br style="background-color: white;" /><span style="background-color: white;">While ensuring the free circulation of ideas and works, cultural policies must create conditions conducive to the production and dissemination of diversified cultural goods and services through cultural industries that have the means to assert themselves at the local and global level. It is for each State, with due regard to its international obligations, to define its cultural policy and to implement it through the means it considers fit, whether by operational support or appropriate regulations.</span><br style="background-color: white;" /></span><br style="background-color: white;" /></span><h3 style="text-align: left;"><span style="font-family: helvetica;"><b style="background-color: white;">CULTURAL DIVERSITY AND INTERNATIONAL SOLIDARITY</b></span></h3><span style="font-family: helvetica;"><b style="background-color: white;"><br /><span style="font-size: medium;">Article 10 – Strengthening capacities for creation and dissemination worldwide</span></b><span style="font-size: medium;"><span style="background-color: white;"></span><br style="background-color: white;" /><br style="background-color: white;" /><span style="background-color: white;">In the face of current imbalances in flows and exchanges of cultural goods at the global level, it is necessary to reinforce international cooperation and solidarity aimed at enabling all countries, especially developing countries and countries in transition, to establish cultural industries that are viable and competitive at national and international level.</span><br style="background-color: white;" /><br style="background-color: white;" /><b style="background-color: white;">Article 11 – Building partnerships between the public sector, the private sector and civil society</b><span style="background-color: white;"></span><br style="background-color: white;" /><br style="background-color: white;" /><span style="background-color: white;">Market forces alone cannot guarantee the preservation and promotion of cultural diversity, which is the key to sustainable human development. Formulating policies and strategies for the preservation and enhancement of the cultural and natural heritage, notably the oral and intangible cultural heritage, and combating illicit traffic in cultural goods and services.</span><br style="background-color: white;" /><br style="background-color: white;" /><span style="background-color: white;">14. He’s a legend in the nonprofit world, so I went to him this week to see if he could offer some clarity and hope in discouraging times. He did not disappoint.</span></div>

Many designers don’t use it, and if they do, they vastly discount its importance. There’s also no science to really back it up. Those who believe the golden ratio is the hidden math behind beauty are falling for a 150-year-old scam.</span></div>

The value this works out to is usually written as 1.6180. The most famous application of the golden ratio is the so-called golden rectangle, which can be split into a perfect square, and a smaller rectangle that has the same aspect ratio as the rectangle it was cut away from. You can apply this theory to a larger number of objects by similarly splitting them down.</span></div>

Except there’s a problem. When you do the math, the golden ratio doesn’t come out to 1.6180. It comes out to 1.6180339887… And the decimal points go on forever.</span></div>

You can get close with more standard aspect ratios. The iPad’s 3:2 display, or the 16:9 display on your HDTV all “float around it,” Devlin says. But the golden ratio is like pi. Just as it’s impossible to find a perfect circle in the real world, the golden ratio cannot strictly be applied to any real world object. It’s always going to be a little off.</span></div>

Yes, it probably would be, if there were anything to scientifically support the notion that the golden ratio had any bearing on why we find certain objects like the Parthenon or the <em style="box-sizing: border-box;">Mona Lisa</em> aesthetically pleasing.</span></div>

Devlin says the idea that the golden ratio has any relationship to aesthetics at all comes primarily from two people, one of whom was misquoted, and the other of whom was just making shit up.</span></div>

<span style="color: #444444; font-family: "helvetica neue" , "arial" , "helvetica" , sans-serif;">The first guy was Luca Pacioli, a Franciscan friar who wrote a book called <em style="box-sizing: border-box;">De Divina Proportione</em> back in 1509, which was named after the golden ratio. Weirdly, in his book, Pacioli didn’t argue for a golden ratio-based theory of aesthetics as it should be applied to art, architecture, and design: he instead espoused the Vitruvian system of rational proportions, after the first-century Roman architect, Vitruvius. The golden ratio view was misattributed to Pacioli in 1799, according to Mario Livio, the guy who literally <a href="http://books.google.com/books?id=w9dmPwAACAAJ" style="box-sizing: border-box; text-decoration-line: none;" target="_blank">wrote the book on the golden ratio</a>. But Pacioli was close friends with Leonardo da Vinci, whose works enjoyed a huge resurgence in popularity in the 19th century. Since Da Vinci illustrated <em style="box-sizing: border-box;">De Divina Proportione</em>, it was soon being said that Da Vinci himself used the golden ratio as the secret math behind his exquisitely beautiful paintings.</span></div>

<span style="color: #444444; font-family: "helvetica neue" , "arial" , "helvetica" , sans-serif;">One guy who believed this was Adolf Zeising. “He’s the guy you really want to burn at the stake for the reputation of the golden ratio,” Devlin laughs. Zeising was a German psychologist who argued that the golden ratio was a universal law <a href="http://books.google.com/books?id=Vk_CQULdAssC&pg=PA306#v=onepage&q&f=false" style="box-sizing: border-box; text-decoration-line: none;" target="_blank">that described</a> “beauty and completeness in the realms of both nature and art… which permeates, as a paramount spiritual ideal, all structures, forms and proportions, whether cosmic or individual, organic or inorganic, acoustic or optical.”</span></div>

For example, <a href="http://www.sacred-geometry.es/?q=en/content/phi-human-body" style="box-sizing: border-box; text-decoration-line: none;" target="_blank">Zeising argued</a> that the golden ratio could be applied to the human body by taking the height from a person’s navel to his toes, then dividing it by the person’s total height. These are just arbitrary body parts, crammed into a formula, Devlin says: “When measuring anything as complex as the human body, it’s easy to come up with examples of ratios that are very near to 1.6.”</span></div>

Zeising’s theories became extremely popular, “the 19th-century equivalent of the Mozart Effect,” according to Devlin, referring to the <a href="http://www.theverge.com/2013/12/12/5204124/the-mozart-effect-myth-research-finds-music-doesnt-make-you-smarter" style="box-sizing: border-box; text-decoration-line: none;" target="_blank">belief that listening to classical music improves your intelligence</a>. And it never really went away. In the 20th century, the famous Swiss-French architect Le Corbusier based his Modulor system of anthropometric proportions on the golden ratio. Dalí painted his masterpiece <em style="box-sizing: border-box;">The Sacrament of the Last Supper</em> on a canvas shaped like a golden rectangle. Meanwhile, art historians started combing back through the great designs of history, trying to retroactively apply the golden ratio to Stonehenge, Rembrandt, the Chatres Cathedral, and Seurat. The link between the golden ratio and beauty has been a canard of the world of art, architecture, and design ever since.</span></div>

<span style="color: #444444; font-family: "helvetica neue" , "arial" , "helvetica" , sans-serif;">Devlin tells me that, as part of an ongoing, unpublished exercise at Stanford, he has worked with the university’s psychology department to ask hundreds of students over the years what their favorite rectangle is. He shows the students collections of rectangles, then asks them pick out their favorite one. If there were any truth behind the idea that the golden ratio is key to beautiful aesthetics, the students would pick out the rectangle closest to a golden rectangle. But they don’t. They pick seemingly at random. And if you ask them to repeat the exercise, they pick different rectangles. “It’s a very useful way to show new psychology students the complexity of human perception,” Devlin says. And it doesn’t show that the golden ratio is more aesthetically pleasing to people at all.</span></div>

<span style="color: #444444; font-family: "helvetica neue" , "arial" , "helvetica" , sans-serif;">Devlin’s experiments aren’t the only ones to show people don’t prefer the golden ratio. <a href="http://groups.haas.berkeley.edu/marketing/PAPERS/PRIYA/p22.pdf" style="box-sizing: border-box; text-decoration-line: none;" target="_blank">A study from the Haas School of Business at Berkeley</a> found that, on average, consumers prefer rectangles that are in the range of 1.414 and 1.732. The range contains the golden rectangle, but its exact dimensions are not the clear favorite.</span></div>

<span style="color: #444444; font-family: "helvetica neue" , "arial" , "helvetica" , sans-serif;">Richard Meier, the legendary architect behind the Getty Center and the Barcelona Museum of Contemporary Art, admits that when he first started his career, he had an architect’s triangle made that matched the golden ratio, but he had never once designed his buildings keeping the golden ratio in mind. “There are so many other numbers and formulas that are more important when designing a building,” he tells me by phone, referring to formulas that can calculate the maximum size certain spaces can be, or ones that can determine structural load.</span></div>

<span style="color: #444444; font-family: "helvetica neue" , "arial" , "helvetica" , sans-serif;">Alisa Andrasek, the designer behind <a href="http://www.biothing.org/" style="box-sizing: border-box; text-decoration-line: none;" target="_blank">Biothing</a>, an online repository of computational designs, agrees. “In my own work, I can’t ever recall using the golden ratio,” Andrasek writes in an email. “I can imagine embedding the golden ratio into different systems as additional ‘spice,’ but I can hardly imagine it driving the whole design as it did historically… it is way too simplistic.”</span></div>

<span style="color: #444444; font-family: "helvetica neue" , "arial" , "helvetica" , sans-serif;">Giorgia Lupi of <a href="http://www.accurat.it/" style="box-sizing: border-box; text-decoration-line: none;" target="_blank">Accurat</a>, the Italian design and innovation firm, says that, at best, the golden ratio is as important to designers as any other compositional rule, such as the <a href="http://en.wikipedia.org/wiki/Rule_of_thirds" style="box-sizing: border-box; text-decoration-line: none;" target="_blank">rule of thirds</a>: maybe a fine rule-of-thumb, but one that good designers will feel free to reject. “I don’t really know, in practice, how many designers deliberately employ the golden ratio,” she writes. “I personally have never worked with it our used it in my projects.”</span></div>

Even then, he never sets out to design something with the golden ratio in mind. “It’s important as a tool, but not a rule.”</span></div>

<span style="color: #444444; font-family: "helvetica neue" , "arial" , "helvetica" , sans-serif;">Even designers who are <em style="box-sizing: border-box;">also</em> mathematicians are skeptical of the golden ratio’s use in design. <a href="http://maxwelldemon.com/edmund-harriss/" style="box-sizing: border-box; text-decoration-line: none;" target="_blank">Edmund Harriss</a> is a clinical assistant professor in the University of Arkansas’ mathematics department who uses many formulas to help generate <a href="http://www.theguardian.com/science/alexs-adventures-in-numberland/2015/jan/13/golden-ratio-beautiful-new-curve-harriss-spiral" style="box-sizing: border-box; text-decoration-line: none;" target="_blank">new works of art</a>. But Harriss says that the golden ratio is, at best, just one of many tools at a mathematically inclined designer’s fingertips. “It is a simple number in many ways, and as a result it does turn up in a wide variety of places…” Harriss tells me by email. “[But] it is certainly not the universal formula behind aesthetic beauty.”</span></div>

It’s not in our DNA to be comfortable with arbitrary things like aesthetics, so we try to back them up with our often limited grasp of math. But most people don’t really understand math, or how even a simple formula like the golden ratio applies to complex system, so we can’t error-check ourselves. “People think they see the golden ratio around them, in the natural world and the objects they love, but they can’t actually substantiate it,” Devlin tells me. “They are victims to their natural desire to find meaning in the pattern of the universe, without the math skills to tell them that the patterns they think they see are illusory.” If you see the golden ratio in your favorite designs, you’re probably seeing things.</span></div>

<span style="font-family: "helvetica neue" , "arial" , "helvetica" , sans-serif; font-size: small; font-weight: normal;">This question has taken on some urgency in the past few years, as professed defenders of social justice have clashed with professed defenders of free speech on college campuses. Student advocates have protested vigorously, even violently, against invited speakers whose views they consider not just offensive but harmful — hence the desire to silence, not debate, the speaker. “Trigger warnings” are based on a similar principle: that discussions ofcertain<span style="color: #444444;"> topics will trigger, or </span>reproduce,<span style="color: #444444;"> past trauma — as opposed to merely challenging or discomfiting the student. The same goes for “</span>microaggressions<span style="color: #444444;">.”</span></span></h1>
<h1 class="headline" id="headline" itemprop="headline" style="background-color: white; font-feature-settings: 'kern' 1; line-height: 2.25rem; margin: 0px 0px 10px; visibility: visible;">
<span style="font-family: "helvetica neue" , "arial" , "helvetica" , sans-serif; font-size: small; font-weight: normal;">This idea — that there is often no difference between speech and violence — has stuck<span style="color: #444444;"> many as a coddling or infantilizing of students, as well as a corrosive influence on the freedom of expression necessary for intellectual progress. It’s a safe bet that the </span><a href="http://www.people-press.org/2017/07/10/sharp-partisan-divisions-in-views-of-national-institutions/">Pew survey data</a>released<span style="color: #444444;"> on Monday, which showed that Republicans’ views of colleges and universities have taken a </span>sharp<span style="color: #444444;"> negative turn since 2015, results in part from exasperation with the “speech equals violence” equation.</span></span></h1>
<h1 class="headline" id="headline" itemprop="headline" style="background-color: white; font-feature-settings: 'kern' 1; line-height: 2.25rem; margin: 0px 0px 10px; visibility: visible;">

Early in my career, I taught a course that covered the eugenics movement, which advocated the selective breeding of humans. Eugenics, in its time, became a scientific justification for racism. To help my students understand this ugly part of scientific history, I assigned them to debate its pros and cons. The students refused. No one was willing to argue, even as part of a classroom exercise, that certain races were genetically superior to others.</span></h1>
<h1 class="headline" id="headline" itemprop="headline" style="background-color: white; font-feature-settings: 'kern' 1; line-height: 2.25rem; margin: 0px 0px 10px; visibility: visible;">

We were </span>modeling<span style="color: #444444;"> for the students a fundamental principle of a university education, as well as civil </span>society:When<span style="color: #444444;"> you’re forced to engage a position you strongly disagree with, you learn something about the other perspective as well as your own. The process feels unpleasant, but it’s a good kind of stress — temporary and not harmful to your body — and you reap the longer-term benefits of learning.</span></span></h1>

That’s also true of a political climate in which groups of people endlessly hurl hateful words at one another, and of <a href="http://www.pnas.org/content/111/21/7570">rampant bullying</a><span style="color: #444444;"> in school or on social media. A culture of constant, casual brutality is toxic to the body, and we suffer for it.</span></span></span></h1>

<span style="font-weight: normal;"><span style="font-family: "helvetica neue" , "arial" , "helvetica" , sans-serif; font-size: small;">On the other hand, when the political scientist Charles Murray argues that genetic factors help account for racial disparities in I.Q. scores, you might find his view to be repugnant and misguided, but it’s only offensive. It is offered as a scholarly hypothesis to be debated, not thrown like a grenade. There is a difference between permitting a culture of casual brutality and entertaining an opinion you strongly oppose. The former is a danger to a civil society (and to our health); the latter is the lifeblood of democracy.</span></span></h1>

<span style="font-weight: normal;"><span style="font-family: "helvetica neue" , "arial" , "helvetica" , sans-serif; font-size: small;">Given the evils of hate, any argument for protecting is, at best, an uphill effort and, at worst, simply misguided. Many people either accept or, at least, wonder whether they should accept, an argument that goes something like this: Anyone sensitive to the horror of genocide knows that hate pervades the atmosphere at such times. Few goals can rank higher than preventing genocide and the murderous racial conflicts presented to the world during the twentieth century. Moreover, it is difficult to find any value in the freedom to engage in racist hate speech. Important but ultimately less significant values such as free speech cannot, for any sensitive person, lead to any pause in outlawing the speech that contributes to these horrors. Whether or not the ban will be effective in even a few cases at preventing genocide or racial violence, the mere possibility that it will more than justifies the ban. As an advocate of almost absolute protection of free speech, I should explain the grounds for my valuation of free speech and rejection of the above claim. That explanation, it turns out, is too ambitious for this essay. Nevertheless, Part I describes but does not defend a theory of why racist or hate speech should be protected – a theory that I believe provides the best, though often unrecognized, explanation of existing American case law but one that is surely a controversial, probably minority, view even in the United States. Most readers will realize, as do I, that these theoretical grounds do not really answer my imagined proponent of regulation. Thus, Part II describes the empirical evidence that would cause me to abandon the theory described in Part I, at least in the context of some category of racist or hate speech, but then gives reasons to doubt that this evidence will be forthcoming. In the end, this essay is more a call for more knowledge – I stand ready to be shown that the relevant evidence overrides my doubts about the efficacy of suppression. But given the inevitable empirical uncertainties in evaluating such evidence, Part II does not answer the last sentence of the imagined argument for regulation set forth above about the mere possibility of making a contribution toward prevention. Thus, the final part of this essay offers a different answer: it considers reasons to expect, as a practical matter, that hate speech regulation is more likely to contribute to genocidal events and major events of racial violence than to reduce them. These historical horrors help justify, or so I suggest, greater protection for speech. <span style="color: #999999;">Hosted by the MIT Aga Khan Program for Islamic Architecture<br /><br />Significant transformations in the world's political landscape are signaling the emergence of a new world order that undermines the<br />certitudes established at the end of World War II. At the core of such discussions, the concept of human rights is significantly challenged, calling for a discussion at the core of ethics for the revisions of the principles and mechanisms of intervention. In reaction to these new transformations some have called for a World Parliament representing the people and not governments to replace the UN General Assembly.<br /><br />The workshop addresses the agency of architecture and design in a context where the disrespect of human rights is aggravated by<br />the incapacity of global institutions to react efficiently. What are the ethical questions regarding the architecture of refugees? What timescales, short or long terms, represent a priority for architecture and through which agenda – refugee relief, historical preservation, camp upgrades and daily life, or rebuilding and resettlement? What is the role of design in front of the degradation and destruction of cultural artifacts? How can design be channeled towards peace building objectives and possible resettlement projects? The term “sanctuary city” has been widely used in the great debate over immigration policy and protections. Opponents of sanctuary cities claim that policy protects undocumented immigrants from criminal prosecution, where supporters believe these policies are needed to protect the rights of both citizens and undocumented immigrants.<br />

On Lawyer 2 Lawyer, host Bob Ambrogi joins Matthew J. O’Brien, the director of research at the Federation for American Immigration Reform (FAIR), and Jonathan Blazer, the American Civil Liberties Union’s (ACLU) advocacy and policy counsel, to discuss policy, current legislation, immigration reform, and the status of sanctuary cities under a Trump presidency.<br />
